“Information Training on the Regulation on Immovable Property Trade and EIDS” Held in Kırıkkale

The “Information Training Meeting on the Regulation on Immovable Property Trade” was held in the meeting hall of the Kırıkkale Chamber of Commerce and Industry (KTSO), organized in cooperation with the Provincial Directorate of Trade and the Kırıkkale Association of Real Estate Consultants.

The meeting began with opening speeches by our Provincial Director of Trade, Mr. Mehmet Demir, and the President of the Association, Mr. Ramazan Almaz. It then continued with presentations by officials from the Provincial Directorate of Trade, providing information about the recent changes to the Regulation on Immovable Property Trade and the Electronic Listing Verification System (EIDS).

The training, designed for merchants and/or craftsmen registered with the Kırıkkale Chamber of Commerce and Industry and the Kırıkkale Association of Real Estate Consultants, emphasized the following points based on the latest regulatory updates:

  • As of August 31, 2023, the Regulation on Immovable Property Trade requires listing platforms that provide electronic services for property advertisements to:
    • Verify the identity of the person posting the advertisement,
    • Confirm that the advertised property belongs to the advertiser or their first- or second-degree relatives, spouse, or that the advertiser is authorized by the property owner.
  • The system is expected to be operational as of September 15, 2024. To raise awareness and educate citizens about the system, an EIDS promotional video was presented.
  • Updates and requirements regarding the issuance of the Immovable Property Trade Authorization Certificate were shared with participants.
  • It was reiterated that the Ministry of Trade imposes an administrative fine of 100,000 Turkish Lira for businesses operating without an authorization certificate in 2024, highlighting that no business should operate without proper authorization.

Regarding the recent regulatory updates:

  1. For applications submitted on behalf of individual businesses (real persons) or authorized representatives of legal entities and branches with registered income or corporate tax for immovable property trade as of October 14, 2020:
    • No primary education requirement is necessary for obtaining an authorization certificate.
  2. For applications submitted as of June 5, 2018, with registered income or corporate tax for immovable property trade:
    • Provided that the responsible real estate consultants have received a training certificate from the Ministry of National Education, authorized institutions, or universities, the Level 5 professional competency certificate is not required.
  3. For applications submitted on behalf of businesses and contracted businesses as of October 14, 2020:
    • Authorization certificates could be issued without requiring a minimum of 100 hours of professional training in immovable property trade,
    • It is not required that secondary school graduates have at least 12 months of experience, or that associate, bachelor, or graduate degree holders have at least six months of experience in real estate consultancy or responsible real estate consultancy within the last five years.
  4. As of May 14, 2024, for applications submitted on behalf of businesses and contracted businesses:
    • The professional experience requirement specified in Article 6, Paragraph 1(d)(6) is waived until December 31, 2024 (NACE Codes 68.31.01–68.31.02).

After the presentations by the officials, participants’ questions were answered, and any issues were noted for submission to the Ministry. The meeting concluded following these discussions.
